General Liability Release and Assumption of Risk Agreement
Effective immediately upon execution, I hereby acknowledge and agree as follows:
I do hereby release and forever discharge The Onco-Ballet Foundation and Movement Pointe LLC, their affiliates, agents, employees, successors, assigns, and their respective heirs, personal representatives, affiliates, successors, and assigns, and any and all persons, firms, or corporations liable or who might be claimed to be liable (collectively, “Releasees”), none of whom admit any liability to the undersigned but all expressly denying liability, from any and all claims, demands, damages, losses, expenses, actions, causes of action, or suits of any kind or nature whatsoever, known or unknown, which I now have or may hereafter have, arising out of or in any way relating to any and all injuries and damages of any and every kind, to both person and property, and also any and all injuries and damages that may develop in the future, including, without limitation, personal, bodily, or mental injury, disease, economic loss, or any damage to me, as a result of or in any way relating to participation in activities associated with Releases, including but not limited to ballet, yoga, stretching, breathwork, sound bath, event activities, photography, and video.
I understand that participation involves risks of personal injury, including bodily injury, disease, economic loss, or death, and I voluntarily assume these risks, known or unknown, inherent to these activities. I recognize that it is not possible to specifically list each and every individual injury risk. Waiver Under California Civil Code § 1542: I expressly waive and relinquish any rights and benefits I may have under Section 1542 of the California Civil Code, which reads as follows: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
This means that, notwithstanding the provisions of Section 1542, and for the purpose of implementing a full and complete release and discharge of all parties, I expressly acknowledge that this Release is intended to include in its effect, without limitation, all claims which I do not know or suspect to exist in my favor at the time of execution hereof, and that this Release contemplates the extinguishment of any such claim or claims.
This Release contains the entire agreement between the parties, is binding upon me, my heirs, executors, administrators, personal representatives, successors, and assigns, and shall be governed by the laws of the State of California. It is agreed that this Release may not be altered, amended, or modified, except by a written document signed by both parties. This Release is intended to be as broad and inclusive as permitted by law and does not release, discharge, or waive any claims arising from reckless or intentional acts.
I have carefully read and fully understand the contents of this Release. The terms have been fully explained to me, and I freely, knowingly, and voluntarily agree to its terms.
Photography, Videography, and Text Release Form
I, hereby expressly grant to Movement Pointe LLC, Onco-Ballet Foundation, and their affiliates, subsidiaries, employees, agents, and assigns (collectively referred to as "Releasees"), the irrevocable right to capture my image, likeness, and voice through photography, videography, and text during my participation in activities and events organized by Movement Pointe LLC and Onco-Ballet Foundation. This includes the use of my pictures, silhouettes, and any other reproductions of my physical likeness, as well as any text written about me, including but not limited to my participation in specific Movement Pointe activities or Onco-Ballet events. Such materials may be used in connection with the advertising, promotion, and publicizing of Releasees, including but not limited to, website content, social media posts, public relations efforts, press coverage, blog posts, and printed materials.
I acknowledge and agree that I shall not receive any form of compensation from Movement Pointe LLC or Onco-Ballet Foundation for the use of these photographs, images, or texts, and I waive any rights to approve or claim compensation for any materials produced by Releasees. Furthermore, I grant and convey to Releasees all rights, titles, and interests, including any royalties, proceeds, or other benefits derived from such materials, and consent to the unrestricted use of my image, likeness, and voice in perpetuity, across any medium or format, for any lawful purpose, without further compensation or permission. I hereby release and agree to hold Movement Pointe LLC, Onco-Ballet Foundation, and their respective affiliates and representatives harmless from any claims, damages, or liabilities arising from or related to the use of the aforementioned materials. This release is binding upon my agents, representatives, heirs, assignees, and estate.
I affirm that I am over the age of eighteen (18) years and have the full legal capacity to execute this release. I have read this document in its entirety, fully understand its contents, and intend to be legally bound by it.
Onco-Ballet Foundation Photography and Recording Policy
I, hereby expressly acknowledge and agree that I will only personally record any portion of the activity or event, including classes and rehearsals (hereinafter, "Activity"), organized by Movement Pointe LLC or Onco-Ballet Foundation subject to and in accordance with the following restrictions:
(1) I will only record before or after the Activity organized by Movement Pointe LLC or Onco-Ballet Foundation begins or concludes, with the exception that the only portion of a Movement Pointe LLC or Onco-Ballet Foundation Activity I am permitted to record is final run-throughs of choreography. My Movement Pointe LLC or Onco-Ballet Foundation teacher or instructor will make an announcement before final run-throughs of choreography indicating that participants now have permission to record.
(2) I will ensure that only I am included or featured in any recording I personally record unless I obtain the express consent of any other participants in the Activity to record those participants.
(3) No continuous recording of Onco-Ballet Foundation rehearsal may be posted to or shared to any social media or other website at any time or under any circumstances. However, recordings capturing only a portion or segment of Onco-Ballet Foundation rehearsal may be posted to or shared on social media or other website.
(4) No recording of audio other than music that Movement Pointe LLC or Onco-Ballet Foundation may be playing as part of an Activity is permitted at any time.
I have read this document in its entirety, fully understand its contents, and intend to agree to and uphold the Onco-Ballet Foundation Photography and Recording Policy.
